Terms and Conditions
BHQ is operated by Merkato LLC, doing business as Wheelhouz. In these Terms "BHQ", "we", "us" and "our" refer to Merkato LLC.
1. Acceptance of Terms
By accessing or using the BHQ platform, operated by Merkato LLC, you agree to be bound by these Terms and Conditions. If you do not agree, you may not use the platform.
2. Description of Service
BHQ is an operations management platform for building service contractors. The platform provides tools for managing accounts, supplies, orders, inventory, and team operations across tenants.
3. User Accounts
Access to BHQ requires authentication through your organization's identity provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose
- Attempt to gain unauthorized access to other tenant data
- Interfere with or disrupt the platform's operation
- Upload malicious code or content
- Resell or redistribute access to the platform
5. SMS Notifications
BHQ sends transactional text messages only — never marketing. You consent to receive them in one of two ways: you enable SMS notifications in your own account settings, or an administrator at the business you work for enters your mobile number to invite you to their BHQ account, confirming that you have agreed to receive a text message containing a one-time sign-in link. Section 4 of our Privacy Policy describes both paths in full.
Message frequency varies based on your activity and notification preferences. Message and data rates may apply.
You may opt out at any time by replying STOP; we then send no further text messages to that number. For assistance, reply HELP. SMS notifications are provided by Twilio. Carrier terms and conditions may apply, and carriers are not liable for delayed or undelivered messages.
6. Intellectual Property
The BHQ platform and its original content, features, and functionality are owned by Merkato LLC and are protected by applicable intellectual property laws. Your data remains your property.
7. Data and Privacy
Your use of BHQ is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
8. Limitation of Liability
To the maximum extent permitted by law, Merkato LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
9. Modifications
We reserve the right to modify these Terms at any time. We will notify users of material changes through the platform. Continued use after changes constitutes acceptance of the modified Terms.
